Rad Life Mobility Inc. collects information about its customers that purchase Rad Power Bikes-branded products. This Privacy Policy identifies the information we collect, how we use it, and your rights with respect your information.

To make sure we’re on the same page, when we refer to “RLM,” “we,” “us,” “our,” etc., we mean Rad Life Mobility Inc. The “we” does not include our independent third-party business partners or retail sellers who have their own privacy policies and practices. The “we” also does not include other brands under the Rad Life Mobility house of brands (e.g., Serial 1 and Life EV).

What This Privacy Policy Covers

To use some of our products and services, you may provide us with personal information. Personal Information means information that identifies, relates to, describes, or is capable of being associated with or linked directly or indirectly to a specific person or household. Anonymized information – meaning, information that cannot identify or be linked to a specific person or household – isn’t personal information. Anonymized information means personal data where specific identifying information is removed (e.g., stripped of identifying information in a way that someone could not reverse engineer it to make it personally identifiable).

This Privacy Policy applies to:

  1. Information you provide to us;
  2. Information we may collect when you access our Websites;
  3. Information we receive from third parties

Information You Provide to Us

When you interact with RLM’s Rad Power Bikes-brand Websites and/or make use of our services, you share personal information. Personal Information or personal data means information that identifies, relates to, describes, or is capable of being associated with or linked directly or indirectly to a specific individual or household. The categories/sources of personal information RLM may collect from or about you include:

  • Contact Information. When you purchase a Rad Power Bikes-branded bike online or in-store, perform a test ride, create an account on our Websites (https://www.radpowerbikes.com; https://radpowerbikes.ca), participate in our contests/sweepstakes, use our customer service options, sign up for email notices or promotions, or register your Rad Power Bikes-branded bike, you may provide certain personal contact information such as:
    • First and last name
    • Home or mailing address
    • Email address and telephone number
    • Certain financial information, such as debit/credit card information
    • Emergency contact information (for example, if you do a test ride). Please note, if you submit information about other people to us or our service providers in connection with your interactions with us, you’re making the representation that you have the authority to do so and to permit us to use that information per our Privacy Policy)
  • Government-Issued Identification. If you take a test ride on a Rad Power Bikes-branded bike or if you submit an application for employment with RLM, we may ask you to provide additional information shown on a government-issued ID documentation such as:
    • Birth date
    • Driver’s license or other government-issued ID (which may reflect information like birth date, gender, or your photo)
    • Social Security number (we won’t collect this for applicants, only for those who decide to accept an employment offer)
  • Biometric Data. If you stop by one of our retail locations with a video security system, we may unintentionally capture your image. Don’t worry, that image will not be posted anywhere and is used for security reasons.
  • Payment Information. If you buy a product at one of our retail stores, we will ask for your payment information to process payment, such as credit card, debit card, or other payment method. For online purchases, you’ll be redirected to a third-party payment processor’s site to process payment. Our third-party payment processors have their own privacy policy which we do not control. We may also make financing options available for purchases. If you decide to get financing, you will be sent to a third-party’s site where they may collect and/or get access to information like your credit rating. We do not control or have access to such information.
  • Feedback/Customer Service. If you respond to a survey about your experience with us, offer opinions or reviews on our Websites, or interact with us on social media, we may ask for information like your name and email address, for example. If ever you need help with a product or seek other customer support services such as our online chat feature, we collect data from those interactions. We may also collect purchase history information like products you bought, returned, or exchanged.
  • Job Applications. If you apply for a job with us, we will collect information from your application or resume. If you get an offer and become a part of Team RLM, you may additionally be asked to provide information under the “Government-Issued Identification” section above.

Information We May Collect When You Access our Websites

RLM may collect information when you visit our Websites – even if you don’t make a purchase or set up an account. RLM is not an exception; almost every commercial website uses certain technology that collects information even if you don’t actively provide information. Importantly, WE DO NOT SELL YOUR INFORMATION. We use the information we collect to improve our customers’ experience on the Websites, to improve our services and products, and, if applicable, tailor advertising or communications to you.

What’s Collected What Is It and What Does It Mean? How/Why RLM Uses This Information
Log Files Log files are anonymous and technical information automatically collected from your browser. Log files can include:
  • Your IP address;
  • Device identifier;
  • Version of software you use;
  • The address of linked sites accessed;
  • Error logs
  • Statistical purposes, e.g., number of people who visited our Websites and how long were they on our Websites;
  • Ensure our Websites appear and function properly on your device;
  • Determine whether and which other websites directed or referred you to our Websites;
  • Personalize your access to our Websites;
  • Research to improve our products, services, and content to avoid errors or other issues you may encounter on our Websites.
Cookies

Cookies are unique alphanumeric identifiers that serve different purposes, such as identifying your device, collecting and storing information about your use of our Websites, and in some cases, other websites.

Cookie information allows websites to know you’ve been there before and may help provide information more relevant to you.

Cookies can be session-based or persistent.

  • Session-based: these are temporary cookies that remain on your device until you close your web browser.
  • Persistent: these cookies remain on a device after the user closes their browser and can remember information, settings, preferences or sign-on credentials that the user previously saved.

The cookies we collect are listed below. Users can change cookie preferences to limit the types of cookies used. Keep in mind, however, that disabling certain cookies may impact the functionality of our website. The cookies we use include:

  • Strictly necessary cookies: ensure our Websites function properly and Services are available to you (e.g., log-in functionality, filling in forms).
  • Preference cookies: provide enhanced features or settings based on your previous visits and selections, e.g., language preferences, remember log-in credentials, remember searches and filter settings.
  • Performance and analytics cookies: enable us to understand how users interact with our Websites by collecting and reporting information anonymously – meaning, these cookies do not save information that allows identification of the individual user.
  • Advertising cookies: enable the tracking of users across different websites to display ads that are relevant and engaging to the individual user.
  • Social media cookies: are like advertising cookies set exclusively by social media platforms to track, e.g., when users share or like our content through third party social media sites.
Pixels and Web Beacons Pixels (also referred to as web beacons) are small electronic graphics that appear on a website (though it can be clear so it’s practically invisible to the naked eye) with a unique identifier that serves similar functions to cookies. In short, pixels can track a user’s behavior such as links clicked, pages visited, interactions with marketing material, etc. RLM uses pixels to do things like count the users who have visited our Websites, determine the number of folks who open an email from us, measure ad performance and gather statistics about usage.

Information We May Receive About You From Third Parties

We may obtain information about you from our third party service providers who have their own privacy policies that govern how they use your personal information. Those service providers may include:

  • Payment Processors. We use a third-party to process your payments when you make a purchase on our Websites or at RLM retail locations. When you provide your personal information to make a purchase, RLM will receive some of that information so we can fulfill your order or request.
  • Retail Partners. We have third-party retail partners who make RLM bikes available for in-person purchase or for customer service purposes. Our retail partners provide us with information you provide to them relating to a purchase or customer service request, for example.
  • Social Media Sites. When you interact with us (pressing a “like” button) or post content about us on social media platforms, or access our Websites through a link on a social media site, we may collect certain information from your public profile as well as your interests. Please note, personal information received from a social networking site is governed by that social networking site’s privacy policy, not RLM’s.

How RLM Uses Your Information

We use personal information to provide, maintain and improve our products and services, such as to:

  • Sell and deliver our products to you;
  • Confirm, send, and track your order, subscription, or registration;
  • Send you periodic email and newsletter communications;
  • Respond to your customer service or general inquiries;
  • Provide and operate our Websites and related features;
  • Allow you to participate in interactive features on our Websites or to notify you about changes to our services;
  • Analyze preferences, trends, and use statistics;
  • Comply with applicable laws, regulations, legal processes or court orders.

How We Protect Your Personal Information

We use administrative, technical, and physical safeguards to protect the personal information entrusted to us. We regularly update and test our security measures to improve the protection of your personal information and to ensure the integrity of that information.

We also limit those at RLM who can access personal information on a need-to-know basis and periodically provide employee privacy training to ensure our team understands and exercises best practices to protect personal information.

Finally, we keep your personal information only for so long as needed for legitimate business purposes or to comply with legal or other obligations. The criteria we use to determine retention periods include: (1) the duration of our ongoing relationship with you (e.g., for as long as you have an account or continue to use our services); (2) whether there is a legal obligation to which we are subject (e.g., certain laws require us to keep records for a minimum period); and (3) whether retention is advisable in light of our legal position (e.g., applicable statutes of limitations, litigation, or regulatory investigations). For example, order and transaction records are generally retained for seven (7) years for tax and legal compliance; account information is retained for the duration of your account plus three (3) years; and marketing preferences are retained until you opt out or withdraw consent.

Choices and Rights Regarding Your Information

You maintain control of your personal information. You can email us with such requests at privacy@radlife.com or via any of the ways in the Contact Us section. California residents may also use the “Do Not Sell or Share My Personal Information” link on our Websites to opt out of the sale or sharing of personal information. You have the following rights regarding your personal information:

  • Right to Know. You have the right to know about the personal information we may collect about you and how it’s shared or used. You’re also entitled to request a copy of the personal data we have collected, and upon request, we will provide this data to you in electronic form or transfer it to a third party.
  • Right to Delete. You have the right to request that we delete your personal data when such data is no longer necessary for the purposes for which it was collected or for other requisite legal purposes. Some exceptions apply here; for example, RLM is not required to delete information that: is publicly available such as your address, needed to process your orders/service requests, to comply with legal obligations or to exercise our legal rights. Please note, if we cannot verify that you’re you, we may not be able to delete the information. For example, if someone says “delete my data” but does not include information that allows us to verify the request is legitimately coming from you, e.g., providing the email address matching the email address we have on file, the name of the person making the request lines up with the name of the person we have, etc. Basically, we need to be able to confirm that the data subject is the person making the deletion request.
  • Right to Opt-Out. We don’t sell your personal information. Meaning, we don’t provide your personal information to a third party in exchange for compensation. We may share personal information with third parties for cross-context behavioral advertising (“targeted advertising”). You have the right to opt out of (1) the sale of your personal information, (2) the sharing of your personal information for targeted advertising purposes, and (3) certain automated profiling. To submit an opt-out request, email us at privacy@radlife.com or use the “Do Not Sell or Share My Personal Information” link on our Websites. We also honor browser-based universal opt-out signals, including the Global Privacy Control (GPC). If we receive a GPC signal from your browser, we will treat it as a valid opt-out of sale and sharing of your personal information for targeted advertising.
  • Right to non-discrimination. We’re not going to love you any less if you decide to exercise any of your rights listed here.
  • Right to correct. You have the right to correct your personal data if inaccurate.
  • Right to Limit. You have the right to instruct us to only use your sensitive personal information, e.g., your social security number, financial information, exact geolocation, for limited purposes, such as to provide you with our services or to allow you to purchase one of our products.

Changes to this Privacy Policy

There may be times when we elect or are required by law to make changes to our Privacy Policy. When we do, we will (1) change the “Last updated” date listed at the top of this Policy, and (2) will email individuals whose personal information we maintain, of any material changes.

Children’s Personal Information

RLM’s bikes should not be operated by children under 16 years old. If you are under the age of 16, do not provide your personal information through our Websites. If we learn we have collected or received personal information from a child under 16 (or if you believe your child under 16 provided to RLM personal information) without verification of parental consent, we will delete that information. To notify us, please contact us at privacy@radlife.com. Our Websites are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13 in a manner inconsistent with the Children’s Online Privacy Protection Act (COPPA).

Do Not Track Signals

Some internet browsers may provide users the ability to send “Do Not Track” signals to websites that you visit. RLM does not respond to “Do Not Track” browser settings or signals. However, RLM does honor the Global Privacy Control (GPC) signal. If your browser or browser extension sends a GPC signal, we will process it as a request to opt out of the sale and sharing of your personal information for targeted advertising, as required under applicable state privacy laws including those of California, Colorado, Connecticut, Texas, Montana, Oregon, Delaware, New Hampshire, New Jersey, Maryland, Minnesota, and Nebraska. State-Specific Privacy Rights

If you are a California resident and provide personal information to us, you have the right to request and receive information regarding the disclosure of certain categories of personal information by RLM to our affiliates or third parties for their direct marketing purposes. Any such request for information may be sent to privacy@radlife.com.

California Residents – Additional CCPA/CPRA Disclosures. In the preceding 12 months, RLM has collected the following categories of personal information: (1) Identifiers (name, address, email, phone number, IP address, device identifiers); (2) Commercial information (products purchased, purchase history, returns); (3) Geolocation data (general location derived from IP address); and (4) Sensitive Personal Information (financial payment information, government-issued ID for test rides, biometric data incidentally captured by security cameras). We collected this information from you directly, from your devices automatically, and from third-party service providers. We use this information for the business and commercial purposes described in the “How RLM Uses Your Information” section above. We disclosed each of these categories to third-party service providers for business purposes. We do not sell personal information for money. To exercise your CCPA/CPRA rights, including the right to know, delete, correct, opt out of sale/sharing, limit use of sensitive personal information, and data portability, contact us at privacy@radlilfe.com or (800) 939-0310. Authorized agents may submit requests on your behalf with proper written authorization. We will respond to verifiable consumer requests within 45 days. We will not discriminate against you for exercising your privacy rights.

Residents of Other States. Residents of Virginia, Colorado, Connecticut, Texas, Florida, Oregon, Montana, Iowa, Indiana, Kentucky, Rhode Island, New Hampshire, New Jersey, Delaware, Tennessee, Maryland, and Minnesota may have additional privacy rights under their respective state laws, including rights to access, correct, delete, and obtain a portable copy of your personal data, and to opt out of the sale of personal data, targeted advertising, and certain profiling. To submit a request under any of these state laws, please contact us at privacy@radlife.com or (800) 939-0310. We will respond within the timeframe required by the applicable law (generally 45–60 days). You have the right to appeal a denial of your request; to appeal, submit your appeal to privacy@radlife.com with the subject line “Privacy Rights Appeal.” If your appeal is denied, you may contact your state’s Attorney General. Note: Processing of personal data in a business-to-business (B2B) context (i.e., data of individuals acting in a business capacity) is covered under California law; most other states exempt B2B data from their consumer privacy laws.
